  1. General Terms and Conditions for Home Delivery

    DEFINITIONS
    The following terms have the meanings ascribed to them in these general terms and conditions. Defined terms are indicated in the text with a capital letter, and, depending on the context, may also have the same meaning in the plural form as in the singular:

    • Request: The placement of an order by the Customer on the Travelex Website to have foreign currency delivered to the Customer's home address.
    • General Terms and Conditions: These general terms and conditions.
    • GDPR: General Data Protection Regulation.
    • Order: An order registered via the Website in the name of the Customer for the delivery of foreign currency to the Customer's home address.
    • Parties: Travelex and the Customer.
    • Customer: The natural person who does not act in the exercise of a profession or business and resides in the Netherlands.
    • Agreement: The agreement between Travelex and the Customer for the delivery of foreign currency to the Customer's home address.
    • Travelex: Travelex N.V.
    • Tikkie Zakelijk: The payment link or interface of ABN AMRO N.V. through which payment requests will be made by Travelex to the Customer to complete the Request.
    • Private Purposes: All activities related to the private use of the foreign currency by the Customer.
    • Website: The website of Travelex N.V. where a Request can be placed:https://www.gwktravelex.nl/en/other-services/homedelivery 
    • Wwft: Dutch Money Laundering and Terrorist Financing (Prevention) Act.
    • Ziemann: Ziemann Cashservice Nederland B.V.

    GENERAL PROVISIONS
    The General Terms and Conditions form part of all Agreements and offers made by Travelex. In case of conflict between the General Terms and Conditions and the Agreement, the terms agreed upon in the Agreement shall prevail.

    Changes and additions to the Agreement and General Terms and Conditions are only valid if agreed upon in writing between the Parties.

    The application of other (general) terms and conditions is expressly excluded.

    THE REQUEST
    These General Terms and Conditions apply to every Request made via the Website.

    Before placing a Request, Travelex applies a minimum and maximum amount, which can be found on the Website. Travelex is entitled to adjust the minimum and/or maximum amount at any time on its Website. The minimum and maximum amount that applies to the Agreement is the one in effect at the time the Request is placed on the Website.

    The Customer must follow the instructions on the Website and provide any additional information requested by Travelex employees related to the completion of the Request. If Travelex deems the Request can be successfully completed after following the steps outlined, the Customer will receive a payment link to complete the Request. The invoice must be paid through Tikkie Zakelijk. For more information about Tikkie Zakelijk, refer to the Tikkie website: tikkie.me. Payment must be made within 12 hours of receiving the email.

    Travelex is entitled to refuse a Request at any time if it cannot fulfill its obligations under the Financial Supervision Act, Wwft, the Sanctions Act 1977, or other applicable laws and regulations, if insufficient foreign currency is available, if unforeseen circumstances occur outside of Travelex’s control, if errors are detected in the price or description of the Request, or if the Customer is in violation of these General Terms and Conditions or decides, based on freedom of contract, not to enter into an agreement with the potential Customer.

    The Customer is entitled to a refund of the invoice amount (including VAT) if the Agreement is terminated as described in these General Terms and Conditions, including Article 6.8 and 8.3. Travelex will refund the payment within 5 business days after the termination of the Agreement. The costs of returning the ordered foreign currency are the responsibility of the Customer.

    Any mistakes or omissions on the part of the Customer may result in the invoice being paid without additional charges being applied. The Customer must report these to Travelex by emailing thuisbezorgen@travelex.com. After the invoice has been paid, Travelex is not obligated to accept and process such changes, but may apply conditions and/or additional charges.

    The exchange rates used for the Request are the current rates and may be subject to change at any time. The exchange rates applicable to the Parties are those in effect when Travelex accepts the Customer’s Request. These exchange rates will appear on the order screen when the Customer receives confirmation of the Request.

    The Customer must provide Travelex and/or third parties contracted by Travelex with all the necessary information to process and complete the Request in compliance with applicable laws and regulations. The Customer must provide at least the following information:

    • Type of currency
    • Total amount
    • Street address, house number, and postal code of the delivery address
    • A copy of a valid Dutch passport or Dutch identity card.

    Travelex will verify the provided information against authentication protocols it is required to follow under the Wwft, the Sanctions Act 1977, and other relevant laws and regulations. Travelex reserves the right to request additional information from the Customer at any time and to refuse the Request if there is any suspicion of non-compliance with the aforementioned laws and regulations.

    PRICES
    The prices of foreign currency on Travelex's Website are determined based on the most current exchange rates and in accordance with Section 4.9 of these General Terms and Conditions.

    All prices on Travelex's Website exclude any additional costs such as packaging, transportation, shipping, and/or insurance costs. These costs will be charged to the Customer, along with any other costs deemed necessary by Travelex to fulfill the Request.

    All prices on the Website are inclusive of VAT, unless otherwise stated.

    Payment is made via the Tikkie Zakelijk application, unless Travelex prescribes another payment method. If the Customer is entitled to a refund under these General Terms and Conditions and/or applicable laws and regulations, Travelex will use the Tikkie Zakelijk interface to process the refund. Travelex will refund the amount to the Customer's bank account used to pay the invoice. The Customer is entitled to a refund of the invoice amount (including VAT), excluding the costs for returning the ordered foreign currency.

    CONCLUSION OF AGREEMENT
    The Agreement is concluded once the Request is accepted by Travelex. The Agreement is subject to the suspensive condition that the procedure outlined in Articles 3.3 and 3.4 of the General Terms and Conditions is fully completed. Travelex will immediately confirm the conclusion of the Agreement via email to the Customer.

    SHIPPING
    If Travelex deems the Request can proceed, the Customer will receive an invoice for the Request via email.

    The delivery of the ordered foreign currency will be carried out by Ziemann or another delivery service designated by Travelex. By placing a Request, the Customer agrees to any additional requirements that Ziemann may impose before delivering the ordered currency. These requirements include showing a valid ID to verify the Customer as described in Article 3.8 of these General Terms and Conditions. Ziemann or the other designated delivery service may also require that the order be handed over only behind a closed door for safety reasons. If the Customer does not cooperate or is unable to cooperate with these requirements, it will be considered a situation as described in Article 6.8, and the conditions mentioned there will apply.     Travelex will coordinate with Ziemann to determine the delivery date of the Request and will inform the Customer. Requests will not be delivered on public holidays or Sundays.

    The foreign currency will be transported in sealed seal bags.

    The Customer must check upon receipt whether the ordered foreign currency is properly packed, complete, unopened, and not altered or forged in any way. If there is any damage to the seal bag, the Customer must refuse to accept the foreign currency and contact Travelex. The Customer must report any complaints regarding the foreign currency and/or seal bags to Travelex as soon as possible via email at thuisbezorgen@travelex.com.

    If the complaint is not made within 24 hours, all rights of the Customer regarding the complaint will be forfeited.

    The price of the foreign currency offered is subject to fluctuations in financial markets over which Travelex has no control and which may occur within the 14-day cancellation period as described in Article 6:230o, paragraph 1 of the Dutch Civil Code. The Customer does not have the right to exercise their cancellation right after the Agreement has been concluded, in accordance with Article 6:230p, sub a of the Dutch Civil Code.

    If the Order cannot be delivered for reasons within the Customer's control, Travelex has the right to cancel the Agreement and the ordered foreign currency will be returned to Travelex. The Customer is entitled to a refund as described in Article 3.5. Travelex is entitled to charge the Customer for any costs associated with returning the ordered currency, including transportation costs.

    CUSTOMER OBLIGATIONS
    By placing the Request, the Customer affirms the following to Travelex:

    • The Customer is 18 years or older.
    • The Customer has their home address in the Netherlands.
    • The Customer is the same person who placed the Request.
    • The Customer has read, understood, and agrees to these General Terms and Conditions.
    • The Customer complies with applicable laws and regulations.
    • The Customer will use the ordered foreign currency only for Private Purposes.

    FORCE MAJEURE
    Travelex is not obliged to fulfill any obligation to the Customer if it is hindered by a circumstance beyond its control, including but not limited to: national or international emergency, war, fire, terrorist attack, strike, shortage of currency, or unforeseen legal or regulatory circumstances.

    LIABILITY
    Travelex’s liability for damages arising from the Agreement is limited to direct damages. Travelex is not liable for indirect damages such as lost profit, loss of business, or damage caused by the incorrect or delayed delivery of the ordered currency.

    Travelex is also not liable for damages resulting from incorrect, incomplete, or delayed information provided by the Customer.

    The liability of Travelex is limited to the amount of the paid invoice for the specific Request concerned. In no case shall Travelex be liable for an amount greater than the actual cost paid by the Customer.

    APPLICABLE LAW AND DISPUTES
    This Agreement is governed by Dutch law. All disputes arising from the Agreement or these General Terms and Conditions shall be submitted to the competent court in Amsterdam, Netherlands.
